1. About Animolux Ltd and This Agreement

Vivid Fables is an AI-powered storytelling platform operated by Animolux Ltd, a company registered in England and Wales.

By accessing or using Vivid Fables, you confirm that you are at least 18 years of age and that you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our service.

These Terms constitute the entire agreement between you and Animolux Ltd for your use of Vivid Fables. They are governed by the laws of England and Wales.

2. The Service — What Vivid Fables Provides

Vivid Fables is an AI storytelling tool that enables adults to:

• Generate custom children's stories using AI;
• Produce AI illustrations to accompany stories;
• Listen to stories via text-to-speech narration;
• Save and manage a personal story library.

The service is provided "as is" and on an "as available" basis. While we work hard to maintain a reliable service, we do not guarantee that Vivid Fables will be uninterrupted, error-free, or available at all times.

Technical Requirements

To use Vivid Fables you will need:

• A modern web browser (Chrome 90+, Firefox 88+, Safari 14+, Edge 90+)
• An active internet connection
• JavaScript enabled
• For text-to-speech features: a device that supports the Web Speech API
• For payments: a browser that supports Stripe's secure checkout

AI story generation and image features require consumption of Wonderful Stars (see Section 3). Text-to-speech narration is provided free using your device's built-in speech synthesis.

3. Wonderful Stars — Purchases and Pricing

Vivid Fables uses a virtual credit system called "Wonderful Stars" to generate AI content.

3.1 Free Daily Stars

Every registered user receives 5 free Stars per day to use for AI image generation. Free Stars reset daily and do not roll over or accumulate.

3.2 Purchasing Stars

Additional Stars can be purchased via our secure Stripe payment integration. Current packages are:

All prices are in British Pounds (GBP) and include any applicable charges. Animolux Ltd is currently not registered for VAT, and therefore VAT is not charged on your purchase. The price shown is the final amount you pay.

3.3 Stars Usage and Expiration

• One Star is consumed each time you generate an AI image.
• Stars have no monetary value and cannot be exchanged for cash or transferred to another account.
• Purchased Stars are valid for 12 months from the date of purchase. In the unlikely event that Vivid Fables ceases operations, we will provide at least 30 days' notice for you to use your remaining Stars.
• If your account is terminated under Section 8 (Acceptable Use) for a material breach, any unused purchased Stars will be forfeited. We will not forfeit Stars as a result of our own technical failures.

Payments are processed securely by Stripe, Inc. We do not store your card details. All transactions are subject to Stripe's own terms and policies.

4. Your Right to Cancel (Cooling-Off Period)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have a statutory right to cancel an online purchase within 14 calendar days without giving a reason.

Before Stars Are Credited

If you wish to cancel your order before Stars are credited to your account, you may do so by contacting us at support@vividfables.uk immediately.

5. Refund Policy (Consumer Rights Act 2015)

5.1 Faulty Digital Content

Under the Consumer Rights Act 2015 (CRA 2015), digital content must be of satisfactory quality, fit for purpose, and as described. If Wonderful Stars or AI-generated content fails to meet these standards due to a technical fault on our part:

1. Right to Repair or Replacement: We will first attempt to repair the fault or provide a replacement within a reasonable time and without causing you significant inconvenience.
2. Right to a Price Reduction or Refund: If repair or replacement is impossible, disproportionately costly, or we fail to remedy the fault within a reasonable time, you are entitled to a price reduction or, where the fault is significant, a full or partial refund.

5.2 When We Will Refund Stars

We will credit Stars back to your account (or issue a monetary refund where required by CRA 2015) in the following circumstances:

• Stars were deducted but the AI failed to generate a story or image due to a technical failure of the Vivid Fables platform or our third-party AI providers;
• The content delivered was demonstrably not as described (e.g., completely blank output);
• A double-charge occurred due to a payment processing error.

5.3 When We Do Not Refund

We do not offer refunds or Star credits in the following cases:

• Change of mind after Stars have been successfully credited and are functioning correctly;
• Dissatisfaction with the creative output of the AI where the service performed technically as described;
• Interruption to service caused by your internet connection or device;
• Account termination following a breach of Section 8 (Acceptable Use) by you.

5.4 How to Claim a Refund

To request a refund or Star credit, contact us at support@vividfables.uk with the subject line "Refund Request". Please include your transaction reference and a description of the fault. We will respond within 5 working days.

6. AI-Generated Content — Standards and Reporting

6.1 Service Provided "As Is"

Vivid Fables utilizes third-party artificial intelligence models, including services provided by Google LLC (Vertex AI and Gemini), to generate stories and images. AI-generated content is provided "as is". By its nature, AI may occasionally produce content that is:

• Factually inaccurate or anachronistic;
• Culturally insensitive or inadvertently stereotyped;
• Inconsistent in character or narrative;
• Unexpectedly unsuitable for the requested age group.

We apply content safety filters designed to prevent harmful, offensive, or inappropriate output, but no AI filter is infallible. We do not guarantee that all generated content will be appropriate for every child in every circumstance.

6.2 Reporting Inappropriate Content

If you encounter AI-generated content that you believe is harmful, offensive, or inappropriate, we ask you to report it promptly. Your reports help us improve our safety systems.

7. Parental Responsibility and Supervision

By using Vivid Fables to create content for children, you as the parent or guardian accept the following responsibilities:

• Review Before Sharing: You are responsible for reviewing all AI-generated stories and images before sharing them with a child.
• Supervision: Children should not use Vivid Fables independently. This service is designed for adults (18+) to operate on behalf of children.
• Age Appropriateness: While age-group settings are provided, these are guidelines that inform the AI prompt. They do not constitute a guarantee that all generated content is appropriate for every child in that age bracket.
• Medical & Psychological Disclaimer: Content generated by Vivid Fables is for entertainment and educational purposes only. It does not constitute, and must not be used as a substitute for, professional medical, psychological, or behavioral advice.

8. Acceptable Use & Indemnification

You agree to use Vivid Fables only for lawful purposes. You must not use the platform to generate, store, or share content that:

• Is illegal, including but not limited to child sexual abuse material (CSAM);
• Promotes violence, terrorism, self-harm, or discrimination;
• Defames, harasses, or threatens any individual;
• Infringes upon the intellectual property rights, privacy, or publicity rights of third parties.

We reserve the right to suspend or terminate your account immediately and without notice if we reasonably suspect you have breached these rules.

8.1 User Indemnification

By using Vivid Fables, you agree to indemnify, defend, and hold harmless Animolux Ltd, its directors, and employees from any claims, liabilities, damages, and expenses (including legal fees) arising directly from your violation of these Terms or your use of the platform to generate or distribute unlawful or infringing content.

9. Intellectual Property

9.1 Your Rights to Generated Content

Subject to your compliance with these Terms, Animolux Ltd grants you the right to use, share, and commercialize the stories and images you generate using Vivid Fables. However, you acknowledge that under current UK and international laws, copyright protection may not fully apply to purely AI-generated works.

9.2 Non-Exclusivity

Due to the nature of generative AI, the platform may produce identical or highly similar outputs for different users. You do not hold exclusive rights to any output that is identical or similar to content generated for another user.

9.3 License to Animolux Ltd

By generating content on our platform, you grant Animolux Ltd a limited, non-exclusive license to host, store, and display that content within your account solely for the purpose of operating and providing the Vivid Fables service to you.

10. Limitation of Liability

To the maximum extent permitted by English law, Animolux Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of Vivid Fables, including but not limited to loss of data, loss of anticipated savings, or emotional distress caused by AI-generated content.

Our total liability to you for any direct damages arising under these Terms shall not exceed the total amount you paid to us for Wonderful Stars in the 6 months preceding the claim. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence.

11. Privacy and Data Protection

Your privacy is important to us. Information about how we collect, store, and process your personal data (including email addresses and saved stories) is detailed in our Privacy Policy, which complies with the UK GDPR.

12. Disputes and Governing Law

These Terms, and any dispute or claim arising out of them, shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in the law, our features, or API provider policies. If we make material changes, we will notify you via email or a prominent notice on our website at least 30 days before the changes take effect. Continued use of the service after that date constitutes your acceptance of the new Terms.
